These Terms and Conditions govern your use of inkuttu.com and any purchases you make through us. Please read them carefully — by using the site or placing an order, you agree to be bound by them.

inkuttu.com is operated by INKUTTU Pty Ltd (ABN 53 655 857 042), an Australian company headquartered in Sydney, NSW, Australia.

References in these Terms to INKUTTU, we, us or our mean INKUTTU Pty Ltd. References to you or your mean any person who accesses or uses the site or places an order.

Your agreement to these Terms

By accessing or using inkuttu.com, creating an account or placing an order, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the site.

We may update these Terms from time to time. The current version is always available at this URL. Material changes will be notified to registered customers by email before they take effect. Your continued use of the site after changes are posted constitutes acceptance of the updated Terms.

Eligibility and account

To place an order or create an account, you must be at least 18 years old (or have the consent of a parent or guardian) and capable of forming a legally binding contract under the laws of your country of residence.

You're responsible for keeping your account credentials confidential and for any activity carried out under your account. Tell us immediately at support@inkuttu.com if you suspect unauthorised use.

We reserve the right to refuse service, close accounts, or cancel orders at our discretion — including where we reasonably believe there's been misuse, fraud, or breach of these Terms.

Products, pricing and availability

We make every effort to display products, descriptions and prices accurately. However:

  • Colours may appear slightly different on different screens. We can't guarantee an exact match between on-screen and physical product.
  • Stock is limited and not guaranteed until your order is confirmed and dispatched. Where stock runs out before dispatch, we'll offer a refund or alternative.
  • Prices are shown in Australian Dollars (AUD) and include GST where applicable. Prices may change without notice but won't affect orders already placed.
  • Pricing errors — if a product is listed at a manifestly incorrect price (e.g. a $200 jacket priced at $2 due to a typo), we reserve the right to cancel the order and refund any payment, even after order confirmation.
Placing an order

When you place an order, you're making an offer to buy the product(s) on these Terms. The contract between you and INKUTTU is formed when we send the order confirmation email — not at the point of payment or order placement.

We may decline or cancel orders for any reason, including but not limited to:

  • Stock unavailability
  • Suspected fraud or misuse
  • Pricing or product description errors
  • Inability to verify shipping or payment information
  • Reasonable concerns about the legitimacy of the order

Where we cancel a paid order, we'll refund the full amount to your original payment method.

Shipping, returns and refunds

Shipping rates, dispatch timing and delivery times are set out on our shipping page. International orders are sent on a Delivered Duties Unpaid (DDU) basis — local taxes and import duties are the responsibility of the recipient.

Our returns policy is set out on our returns and refunds page. In summary: full-price items can be returned within 30 days of delivery in original condition, with return postage paid by the customer except where the item is faulty or we've sent the wrong product.

Nothing in these Terms or our returns policy excludes, restricts or modifies any rights you have under the Australian Consumer Law that cannot be excluded by contract.

Your rights under Australian Consumer Law

Our products come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). You're entitled to:

  • A replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage.
  • Have goods repaired or replaced if they fail to be of acceptable quality and the failure is not a major failure.

If a product is faulty, damaged on arrival, materially different from its description, or otherwise fails to meet a consumer guarantee, please contact us at support@inkuttu.com within a reasonable time of becoming aware of the issue. We'll resolve the issue at our cost in line with our obligations under the Australian Consumer Law.

Intellectual property

All content on inkuttu.com — including the INKUTTU name and logo, product imagery, written copy, photography, illustrations, design and code — is owned by or licensed to INKUTTU Pty Ltd and is protected by Australian and international copyright and trademark laws.

You may view, browse and print content for your own personal, non-commercial use. You may not:

  • Reproduce, distribute, modify or republish any content without our prior written consent.
  • Use INKUTTU branding, imagery or copy for commercial purposes.
  • Scrape, data-mine or systematically extract content from the site.
  • Use INKUTTU branding in a way that could mislead others into thinking you're affiliated with us.

User-submitted content

If you submit content to us — including reviews, comments, social media tags using our handles or hashtags, or content sent by email — you grant INKUTTU a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for marketing, customer service and product-improvement purposes, with attribution where reasonable.

You confirm that any content you submit is your own work, doesn't infringe anyone's rights, isn't misleading, defamatory or otherwise unlawful. We reserve the right to remove user-submitted content at our discretion.

Acceptable use of the site

You agree to use inkuttu.com lawfully and in good faith. You must not:

  • Attempt to gain unauthorised access to our systems, accounts or back-end infrastructure.
  • Introduce malware, viruses or any harmful code.
  • Impersonate any person or entity, or misrepresent your affiliation with anyone.
  • Use the site to send unsolicited communications, spam, or abusive messages.
  • Place orders fraudulently, including using stolen payment information or false identities.
  • Interfere with the operation of the site or other users' use of it.

We reserve the right to investigate, suspend access, cancel orders and take legal action against any conduct that breaches these Terms.

Liability

To the maximum extent permitted by law, and except for our obligations under the Australian Consumer Law (which are not excluded by these Terms), INKUTTU's total liability to you in connection with the site or your purchase is limited to the amount you've paid for the relevant product(s).

We're not liable for any indirect, consequential, incidental or special losses, including loss of profits, loss of data, or loss of opportunity, except where Australian law requires otherwise.

The site is provided "as is" — we don't warrant that it will always be available, error-free or free from interruptions. We do, however, take reasonable steps to keep it running smoothly.

Suspension and termination

We may suspend or terminate your access to the site or your account at any time, with or without notice, where we reasonably believe you've breached these Terms or acted unlawfully. Termination doesn't affect any rights or obligations that have accrued before the termination date.

You can close your account at any time by emailing support@inkuttu.com.

Governing law and disputes

These Terms are governed by the laws of New South Wales, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of New South Wales for any disputes arising out of or in connection with these Terms.

Before taking any formal legal action, we'd ask that you contact us first at legal@inkuttu.com so we can try to resolve the issue informally.

General

Severability. If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect.

No waiver. Failure by us to enforce any provision isn't a waiver of our right to do so later.

Entire agreement. These Terms (together with our Privacy Policy and any additional terms presented at checkout) constitute the entire agreement between you and INKUTTU regarding your use of the site, and supersede any prior agreements.

Assignment. We may assign or transfer our rights and obligations under these Terms to an affiliated entity, successor in business, or third party in connection with a sale or restructure of the business.
